1. This is an agreement between the person who signs below (“you” or “I”) and various providers of services in Destin, including the Destin Fishing Fleet, Inc. (the “Fleet”), a separately owned and operated fishing boat d/b/a DESTIN PRINCESS (the “Boat”), and the booking agent if one is involved. I understand that my fishing trip will be aided by distinct and separate businesses, including the Fleet, which is the landlord for multiple boats, and, if applicable, a booking agent, that operates under a separate contract. The Agent that serves under contracts separate from the others, and is referred to here as the “Booking Agent” or “Booking Service.” This Agreement acknowledges your understanding that the above parties each work independently. A fishing trip has inherent risks, such as inclement weather, your physical condition or that of someone for whom you are responsible, and other dangers, known and unknown. You will be responsible for yourself and for those you invite on board, and you waive and hold harmless each of the above, and their agents, from claims arising out of your trip. You will not hold the above parties, or any of them, responsible for inclement or dangerous weather, for illness of any person, drinking to excess, conduct of any passenger, or other mechanical, electronic, or medical event not within the reasonable control of the Captain. This agreement is made specifically in consideration for the willingness of the above parties to provide services to you or to others for whom you are responsible. This waiver and indemnity are made by you for you and your heirs.
2. We will supply you with a fishing rod and reel for use during your excursion. Our policy is that you will pay us $300 per rod if lost, regardless of how it is lost, or broken.
3. All children must have met their 5th birthday to board the boat at any time, and if you have brought a child/children, you are verifying that this child/these children are 5 years of age at a minimum. If your child/children have not yet turned 5 years of age, you agree to NOT allow them aboard our vessel for their safety and the safety of others.
4. You hereby warrant that the credit card that you used to pay for this excursion either belongs to you or that you have the express permission to make these charges on this card that belongs to someone else who is paying on your behalf.

This agreement is to be construed by the laws of Florida in Okaloosa County, Florida.
